Moskalkova told about the legal basis for the release of Vyshinsky

A legal basis has emerged for the release of the head of the RIA Novosti Ukraine portal, Kirill Vyshinsky , by order of the Constitutional Court of Ukraine, his charges do not oblige to imprison the charges, the Commissioner for Human Rights in the  Russian Federation Tatyana Moskalkova said .
Moskalkova arrived in  Kiev on Monday for a court hearing on the Vyshinsky case.
“It’s hard to make any predictions for today. But I’m doing my best to get as much information as possible to release Cyril Vyshinsky from custody. Today there is a ruling by the Constitutional Court that the articles imputed to Cyril Vyshinsky are not fall under the list of articles mandatory for detention as a preventive measure. There is a legal basis for resolving the issue, “Moskalkova told reporters.
Vyshinsky was taken into custody in Kiev on May 15, 2018. The journalist was announced that he was suspected of supporting the self-proclaimed republics of Donbass and treason. The maximum penalty for this article is up to 15 years in prison. Kherson City Court on May 17 arrested Vyshinsky.
Russian President  Vladimir Putin called the situation unprecedented, saying that Vyshinsky was arrested “for his direct professional activities, for carrying out his journalistic function.” Moscow sent Kiev notes of protest demanding an end to violence against members of the press.
OSCE Representative on Freedom of the Media, Arlem Dezir, expressed serious concern over the actions of Kiev regarding RIA Novosti Ukraine. After another extension of Vyshinsky’s detention, Dezir expressed disappointment with Ukraine’s position and called for the release of the journalist. OSCE Secretary General Thomas Greming , commenting on the situation with Vyshinsky, stressed that all countries of the organization pledged to help create conditions in which journalists can fulfill their obligations in another participating State, and therefore must comply with international standards and not interfere with the work of the media.
Negotiations between Moskalkova and Ukrainian Ombudsman Lyudmila Denisova took place a few hours before the court session on the Vyshinsky case, four days after the telephone conversation between the presidents of Russia and Ukraine, Vladimir Putin and  Vladimir Zelensky , during which it was announced that the Kremlin would continue its work level for all persons withheld. At the same time, earlier the head of the political council of the Ukrainian party “Opposition Platform – For Life” Viktor Medvedchukwho dealt with the issues of the liberation of Russians and Ukrainians, noted that the fate of Vyshinsky was always the subject of negotiations. At the same time, Medvedchuk stressed that it is impossible to talk about a bundle of release of Vyshinsky and the Ukrainian sailors detained during the incident in the Kerch Strait, but everyone should be released.
Moskalkova at the talks with Denisova on Monday again discussed the fate of Vyshinsky. After their meeting, Denisova appealed to the leadership of the Ministry of Internal Affairs of Ukraine and the president of the court with a request to ensure the presence of Moskalkova at the meeting and not to allow provocations – about attempts to pressure judges from the Ukrainian radicals Moskalkova earlier on Monday.
